Welcome to Cake ("Cake," "we," "our," or "us"). By accessing our website, placing an order, submitting an inquiry, or utilizing our services, you agree to the following Terms & Conditions.

1. Website Use

This website and its content are intended for lawful use only. Users agree not to interfere with the operation of the website, attempt unauthorized access to any portion of the website, transmit malicious code, or engage in any activity that may disrupt website functionality or infringe upon the rights of others.

2. Order Acceptance

Cake reserves the right to refuse, decline, modify, or cancel any order at its sole discretion, including orders that cannot be fulfilled due to scheduling constraints, product availability, inaccurate information, safety concerns, or other circumstances beyond our control.

3. Services

Cake provides custom cakes, desserts, edible art, installations, prop rentals, and related event services. Every effort will be made to complete services professionally, accurately, and in a timely manner.

All products are handcrafted and custom-made. Variations in color, design details, and decoration may occur and are considered part of the artistic process.

4. Pricing & Payment

A non-refundable deposit of fifty percent (50%) of the total order amount is required to secure an event date unless otherwise specified in writing.

The remaining balance is due seven (7) days prior to the scheduled delivery or event date. Failure to remit payment by the due date may result in cancellation of the order, forfeiture of all payments made, and release of the reserved date.

Rush orders requested within two (2) weeks of the event date may be subject to additional fees. Custom installations are subject to a minimum order requirement of $750. Full payment may be required at the time of booking for rush orders.

All pricing is subject to change until an order has been confirmed and a deposit has been received.

5. Order Changes

Requests for changes to an order, including design, flavors, quantity, size, delivery details, event location, or event date, must be submitted in writing and approved by Cake no less than seven (7) days prior to the scheduled event date.

Additional charges may apply depending on the nature of the requested changes. All modifications are subject to availability and approval.

6. Cancellations & Refunds

All sales are final.

Deposits and payments made toward custom orders are non-refundable and non-transferable. If a client cancels an order for any reason, all payments made will be forfeited.

In the unlikely event that Cake must cancel an order, the client will receive a full refund of all payments made.

7. Design & Creative License

Cake retains full creative control over all custom designs, aesthetics, and artistic elements of cakes, desserts, displays, and installations.

While inspiration photos, reference images, and client preferences are welcomed, we reserve the right to make design decisions based on artistic expertise, structural integrity, product quality, and availability of materials.

Clients acknowledge that custom creations may vary from inspiration images, sketches, renderings, or previous work.

8. Delivery & Pick-Up

If delivery is selected, Cake will deliver the order to the location provided by the client. The client is responsible for providing accurate delivery information and ensuring access to the venue.

A fifteen (15) minute grace period is provided upon arrival. If no responsible party is available, we may leave the order in the safest available location at the venue.

Once delivery is completed or an order is picked up, responsibility for the product transfers to the client. Cake is not responsible for damage caused by handling, transportation, venue conditions, weather, accidents, or improper storage after delivery or pick-up.

Clients are responsible for ensuring that cakes and desserts are stored in a suitable environment, ideally at an ambient temperature of 75°F or below.

9. Allergens & Dietary Restrictions

While we may offer gluten-free, vegan, or allergy-conscious options, all products are prepared in facilities where common allergens may be present.

Products may contain or come into contact with milk, eggs, wheat, soy, peanuts, tree nuts, and other allergens. Cross-contamination cannot be guaranteed against.

Clients assume responsibility for informing guests of potential allergen risks. Cake shall not be held liable for allergic reactions or related health concerns.

10. Fresh Flowers & Decorative Elements

Fresh flowers, foliage, candles, toppers, decorative accents, and other non-edible elements are not food products and may contain pesticides, insects, wire, pins, or other materials unsuitable for consumption.

These items should be removed prior to serving. Cake is not responsible for any issues arising from the use of decorative elements.

11. Equipment & Prop Rentals

Any rented stands, platters, candles, vases, displays, props, or other equipment remain the property of Cake.

Clients agree to return all rental items in their original condition. Lost, stolen, damaged, or unreturned items will incur replacement charges equal to the full replacement value of the item.

12. Product Safety

Many cakes require internal support structures, including wooden dowels, skewers, straws, or other structural elements necessary for stability and transportation.

It is the client's responsibility to ensure these elements are removed before serving or consumption.

13. Intellectual Property & Photography

All cake designs, concepts, photographs, creative work, website content, graphics, logos, images, text, and other materials are the intellectual property of Cake unless otherwise stated.

No content from this website may be copied, reproduced, modified, distributed, published, or used without prior written permission.

Cake reserves the right to photograph completed work and use images for marketing, advertising, portfolio, website, social media, editorial, and promotional purposes without compensation to the client.

14. User Submissions

Any reviews, testimonials, comments, feedback, suggestions, photographs, or other content voluntarily submitted to Cake may be used for marketing and promotional purposes.

By submitting such content, you grant Cake a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and distribute the content.

15. Third-Party Links

This website may contain links to third-party websites, services, or platforms. Cake is not responsible for the content, privacy practices, or policies of any third-party website and assumes no liability for damages or losses resulting from their use.

16. Indemnification

You agree to indemnify, defend, and hold harmless Cake, its owners, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of the website, violation of these Terms & Conditions, misuse of products or services, or failure to follow handling and safety instructions.

17. Force Majeure

Cake shall not be liable for delays, cancellations, or inability to perform due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, severe weather, power outages, labor disputes, transportation interruptions, government actions, public emergencies, or other unforeseen events.

Reasonable efforts will be made to communicate with clients and fulfill obligations whenever possible.

18. Limitation of Liability

To the fullest extent permitted by law, Cake's liability for any claim arising out of services or products provided shall be limited to the amount paid by the client for the applicable order.

Cake shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of this website, products, or services.

19. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California.

Any disputes arising from these Terms & Conditions or services provided by Cake shall be subject to the exclusive jurisdiction of the courts located within California.

20. Changes to These Terms

Cake reserves the right to modify these Terms & Conditions at any time. Updated versions will be posted on this page with a revised effective date.

Continued use of the website after any modifications constitutes acceptance of the updated Terms & Conditions.
